Don't like your iPhone 3G? - sue

We've all bought something that didn't quite live up to the hype but while most of us just shrug, over in the US they take action - legal action.
Birmingham resident (that's Birmingham, Alabama), Jessica Alena Smith, is taking on the might of Apple to file a class-action lawsuit over reception and speed problems she's been having with her new purchase.
Despite what she says is generally 'excellent' 3G coverage in the area, Smith claims that her Internet and emails are, "slower than expected and advertised," which is a bit of a bummer since Apple promised a phone, 'twice as fast for half the price'.
That makes it a defective product in her eyes - and one that Apple is profiting from. Grounds to sue if you ask an eager attorney.
And Smith isn't alone. Problems have even been acknowledged by Steve Jobs himself, who says "around 2%" of the iPhone's shipped are affected.
Still, that's a lot of angry owners. The papers submitted in this case claim the suit has at least 100 members, looking for damages in excess of $5 million. Remind us not to ever piss off any Americans.
Update: And watch out RIM. Apparently the BlackBerry Bold's having the same sort of problems. Someone call a lawyer.
